ABSTRACT Background: From a phenomenological perspective, our body is the “from-which” we face the world. Vice versa, our body is affected by occurrences in our surroundings. Embodied resilience is understood as a quality of the dynamic relationships between our affected body and what happens in our surroundings. Objectives: This article explores the following question: How is resilience experienced bodily and how can we strengthen resilience and foster social relations? Research design: The data consists of ten in-depth interviews, personal observations and (...) reflexive dialogues with the research team on the lived experiences of the participants. Interpretative phenomenological analysis is applied, and relevant literature is outlined in the discussion and the findings are presented. Findings: We discovered three intertwined experiential dimensions of embodied resilience: the experience of (1) sensing: becoming aware of what bodily happened; (2) connecting: looking for resources; and (3) responding: moving towards a new equilibrium. Discussion and conclusion: Lived, embodied experiences play an important role in the dynamic process of resilience. The body helps us resonate with the world we live in. We recommend researching further how an affective touch can enhance embodied resilience and foster social relationships in organisations. (shrink)

This research brings together insights from philosophy, political theory, and consumer research in conceptualizing and empirically examining the social dimension of negative and positive freedom in consumption. Drawing from ethnographic observations and interviews with Moroccan women regarding their shopping at the supermarket, the findings detail the roles of husbands, store employees, extended family members and friends as constrainer, protector, enabler, facilitator, indulger, and witness. The discussion explains a ‘domino effect’ in such innovative marketplaces, as these market and social actors together (...) enact positive and negative forms of freedom in consumption in ways that co-disrupt social traditions. Implications for business ethics emphasize the need for greater theoretical understanding and practical transparency and accountability regarding the shared, yet disparate responsibilities among businesses and consumers for the changes to social traditions that result in the joint enactment of women’s freedom in consumption. Valorising the biocultural heritage of common goods could enable peasant farmers to achieve socially and economically inclusive sustainability. Increasingly appreciated by consumers, peasant heritage products offer small farmers promising opportunities for economic, social and territorial development. Identifying the obstacles and levers of this complex, multi-scale and multi-stakeholder objective requires an integrative framework. We applied the panarchy conceptual framework to two cases of participatory research with small quinoa producers: a local fair in Chile and quinoa export production in Bolivia. In both (...) cases, the “commoning” process was crucial both to bring stakeholders together inside their communities and to gain outside recognition for their production and thus achieve social and economic inclusion. Despite the differences in scale, the local fair and the export market shared a similar marketing strategy based on short value chains promoting quality products with high identity value. In these dynamics of biocultural heritage valorisation, the panarchical approach revealed the central place as well as the vulnerability of the community territory. As a place of both anchoring and opening, the community territory is the privileged space where autonomous and consensual control over the governance of common biocultural resources can be exercised. In this article we describe two core ontologies of law that specify knowledge that is common to all domains of law. The first one, FOLaw describes and explains dependencies between types of knowledge in legal reasoning; the second one, LRI-Core ontology, captures the main concepts in legal information processing. Although FOLaw has shown to be of high practical value in various applied European ICT projects, its reuse is rather limited as it is rather concerned with the structure of legal reasoning (...) than with legal knowledge itself: as many other “legal core ontologies”, FOLaw is therefore rather an epistemological framework than an ontology. Therefore, we also developed LRI-Core. As we argue here that legal knowledge is based to a large extend on common-sense knowledge, LRI-Core is particularly inspired by research on abstract common-sense concepts. The main categories of LRI-Core are: physical, mental and abstract concepts. Roles cover in particular social worlds. Another special category are occurrences; terms that denote events and situations. We illustrate the use of LRI-Core with an ontology for Dutch criminal law, developed in the e-Court European project. (shrink)

This paper explores the structural similarities between Hegel’s conception of spirit and the Jewish medieval text, the Zohar’s, figuration of Shekhinah. The formal logic of spirit’s self-actualization is historically exemplified by Shekhinah in her existence as divinity’s indwelling presence in the world and her mythic embodiment of Jewish history. This study reads Shekhinah’s journey towards union with God as analogous to spirit’s passage towards absolute knowledge, a passage which concludes with what is often referred to as spirit’s ‘return to its (...) elf.’ Contrary to some popular interpretations of Hegel, spirit’s return is an iterative, tautological return to itself as differentiated in itself. The discussion concludes with the claim that Shekhinah’s eschatological journey towards harmonious reunion with God occurs through a proleptic movement in which biblical past and prophesied future, or the Jews’s historically first and theoretically final redemption from exile, coalesce in a here and now in a similarly iterative manner which precludes it from a determinate, apocalyptic end. It is generally assumed that electronic cryptography benefits democracy because it can be instrumental in protecting free speech, which is considered a cornerstone for democracy. The author argues, however, that a close look at some aspects of democratic theory suggests that matters are not really as clear-cut. The fact that encryption can be abused in many ways also poses a threat to democracy. This paradox is examined in detail.

A comparison between the Prolegomena of Chapter II of De iure praedae and the Prolegomena of De iure belli ac pacis leads to the conclusion that the ideas of Grotius on legal systematization have changed considerably between 1604 and 1625. Whereas Grotius starts in IPC with general principles with a rather unclear distinction between leges and regulae, in IBP he gives first the philosophical and theological basis of international law, intertwined by a concise set of general legal rules , mostly (...) derived from Roman law after its reception in Western Europe. The general outlines of legal systematization in the early-modern period are expounded. In the attempts of legal systematization the concept of subjective rights is essential. These subjective rights are not, as is sometimes assumed, a medieval renewal of legal technique, but can be found essentially already in classical Roman law of the first centuries AD. (shrink)

We report on an experiment examining whether individuals can solve a simple signal extraction problem of the type found in models with imperfect information. In one treatment, subjects must form point predictions based on observing both public and private signals, while in another they receive the same information but must decide on the weight to attach to each signal, which then determines their point prediction. We find that, at the aggregate level, signal extraction provides a good characterization of subjects’ behavior (...) in both treatments, but at the individual level, there is considerable heterogeneity in subjects’ ability to perform signal extraction. Xu Fuguan (1904-1982) is one of the central representatives of the second generation of Taiwanese Modern Confucianism. This book focuses primarily on his fundamental contributions to the philosophy of this intellectual current, particularly his reinterpretations and reevaluations of the basic axiological concepts of the original Confucian and Daoist aesthetics. It also addresses issues related to his attempts to preserve, systematize, and modernize traditional Chinese aesthetics. Xu Fuguanâ (TM)s theory of the Chinese ideational tradition is defined by the paradigm of the (...) traditional link between ethics and aesthetics. The book highlights the importance of the complementary interaction between Confucianism and Daoism in Xuâ (TM)s theory. In his interpretation of Chinese aesthetics, Xu also incorporated a comparative perspective and contrasted it with Western aesthetics. However, the book shows that his analysis of Western aesthetics is too generalized and therefore problematic. These difficulties are also manifested in Xuâ (TM)s superficial understanding of modern Western art and culture. Nevertheless, this does not detract from the great relevance of his studies of traditional Chinese aesthetics. Xu Fuguanâ (TM)s central theoretical contributions, such as the concept of concerned consciousness, the concept of qiyun shengdong, and the systematic explanation of the axiological foundations of Chinese aesthetics presented and analyzed in this book, are among the most important philosophical innovations elaborated by Modern Confucian theory. These novel approaches are also interesting from the perspective of global theoretical discourses, as they reveal important, culturally conditioned differences between traditional Western and traditional Chinese philosophy in terms of their respective ways of perceiving and interpreting reality. The subject animal welfare is increasingly in the public discourse. Consumers and policymakers are increasingly demanding products that are produced under increased animal welfare standards. The profession of the farmer involuntarily gets into disrepute. Many consumers want fundamental changes in pig farming, but are not aware of the consequences of implementation. In this representative study, consumers (n = 1101) were asked about their assessment of 33 animal welfare measures with regard to their importance and the feasibility of implementing those measures. (...) With the help of a four-field matrix, both the perceived importance and the feasibility of the animal welfare measures surveyed were brought together. The results show four possibilities: important and easy to implement, important and not feasible, not important and easy to implement as well as not important and not feasible. The results show that any outdoor access to pasture ranks first, followed by any outdoor access to straw bedding. The results can make a significant contribution to future communication with critical consumers concerning the implementation of higher animal welfare levels, as it becomes clearer how realistic consumers are about the feasibility of several animal welfare measures. Furthermore, the results could prove useful for the design of animal welfare programs and could help famers making targeted decisions concerning stable construction and management. (shrink)

This article presents an analysis of Turkish film screenings in Belgium as a case study of diasporic media practices in Europe. Turkish blockbusters have only recently become part of the programs of Belgian mainstream film theaters. This study provides insight into both historical and recent dynamics that characterize this new film and audience segment in film exhibition. After analyzing transnational patterns of distribution, selection and promotion, we put forward that changing circulation patterns and the associated power relations define the social (...) and spatial conditions of reception, resulting in the creation of new semi-public diasporic spaces. Thus, the links between the political economy of media and audience research are discussed. The findings of this article are based on archival and press research and a series of semi-structured expert interviews with exhibition and distribution professionals, as well as social workers and representatives from Turkish cultural associations. Study of Hans-Georg Gadamer's and Julius Stenzel's interpretations of Plato.

Building upon social and racial identity theories, this study examines the role of positive relational climate in predicting interpersonal helping behaviors (IHBs) at the workplace. Within this context, we examine both the role of mutual respect and psychological safety as exemplars of positive relational climate, and the mediating role of organizational identification (OI). The study also recognizes the importance of individual differences by examining racial differences in OI and IHBs. Engagement with stakeholders and civil society is increasingly important for new scientific and technological developments. Preparation of such engagements sets the stage for engagement activities and thus contributes to their outcomes. Preparation is a demanding task, particularly if the facilitating agent aims for timely engagement related to emerging technologies. Requirements for such preparation include understanding of the emerging science & technology and its dynamics. Multi-level analysis and socio-technical scenarios are two complementary tools for constructing productive engagement. Examination of the emergence (...) of nanotechnologies in the food packaging sector demonstrates how these tools work. In light of recent policy demands for responsible innovation, but also more generally, the role of organizers of engagement activities is one that deserves reflection insofar as it can extend beyond that of preparation and facilitation. Irena Štěpánová in this book explores Isaac Newton’s engagement with ancient wisdom, the Hexameral tradition, Hermeticism, theology, alchemy as well as natural philosophy. In so doing, she brings together the established historiography with her own new insights. Štěpánová’s study is more than a study of Newton’s thought, for it contains a good deal of background on ancient (e.g., Hermeticism) and early modern thought (e.g., the Cambridge Platonists). She also uses the interpretative lenses of several contemporary Newton and non-Newton scholars in (...) her work. Moreover, provides helpful summaries of Newton’s thought (e.g., his theology). Štěpánová has provided Newton scholarship a great service in this book, not only by making her Czech-language work available in English, but bringing to the English-language reader learning on Hebraic thought, philosophy of life and Hermeticism originally published in Czech. To realize a successful and collaborative interaction between human and robots remains a big challenge. Emotional reactions of the user provide crucial information for a successful interaction. These reactions carry key factors to prevent errors and fatal bidirectional misunderstanding. In cases where human–machine interaction does not proceed as expected, negative emotions, like frustration, can arise. Therefore, it is important to identify frustration in a human–machine interaction and to investigate its impact on other influencing factors such as dominance, sense of control (...) and task performance. This paper presents a study that investigates a close cooperative work situation between human and robot, and explore the influence frustration has on the interaction. The task for the participants was to hand over colored balls to two different robot systems. The robot systems had to throw the balls into appropriate baskets. The coordination between human and robot was controlled by various gestures and words by means of trial and error. Participants were divided into two groups, a frustration- and a no frustration- group. Frustration was induced by the behavior of the robotic systems which made errors during the ball handover. Subjective and objective methods were used. The sample size of participants was N = 30 and the study was conducted in a between-subject design. Results show clear differences in perceived frustration in the two condition groups and different behavioral interactions were shown by the participants. Furthermore, frustration has a negative influence on interaction factors such as dominance and sense of control. The study provides important information concerning the influence of frustration on human–robot interaction for the requirements of a successful, natural, and social HRI. The results are discussed in favor of how a successful und effortless interaction between human and robot can be realized and what relevant factors, like appearance of the robot and influence of frustration on sense of control, have to be regarded. One of the biggest challenges of the study and practice of ethics is that of the moral dilemma, e.g. how should a compassionate person deal with injustice? This paper attempts to resolve this thorny issue from the perspective of Buddhist philosophy. I firstly introduce the 14th Dalai Lama’s distinction between act and actor and suggest a way to denounce wrongful acts without harboring hatred towards the perpetrator. Secondly, I argue that the philosophical grounds of this distinction can be traced back (...) to ancient Buddhist texts on Non-Self and Emptiness, which take all things as being in a constant state of change. Thirdly, I point out that a unique feature of the ‘empty ethics’ of Buddhism is that it inspires a middle way approach which allows for congruity between justice and compassion, between the realistic and the idealistic, and between rationality and sentimentality. Based on this, I suggest that it has much to contribute to contemporary ethics. (shrink)

The Leibniz Center for Law is involved in the project Digitale Uitwisseling Ruimtelijke Plannen [DURP (http://www.vrom.nl/durp); digital exchange of spatial plans] which develops a XML-based digital exchange format for spatial regulations. Involvement in the DURP project offers new possibilities to study a legal area that hasn’t yet been studied to the extent it deserves in the field of Computer Science & Law. We studied and criticised the work of the DURP project and the Dutch Ministry of internal affairs on metadata (...) for regulatory documents, and made an inventory of issues related to legal knowledge representation that it felt were not sufficiently covered by current initiatives in the Geographic Information Systems (GIS) field. This inventory was an input to the DURP standardisation effort. In a second phase of the project we extended the METALex XML schema (cf. Boer et al. 2002; Boer et al. 2003) for ‚regular’ legal sources that we developed in the past for geospatial regulatory information, in order to support exchange of spatial regulations, including the associated geospatial information in the form of maps. We developed a prototype application and demonstrated how the spatial planning information in GML can be combined with XML with only minimal changes, using the Web Ontology Language (OWL). The special composition question, which asks under which conditions objects compose a further object, establishes a central debate in modern metaphysics. Recent successes of inductive metaphysics, which studies the implications of the natural sciences for metaphysical problems, suggest that insights into the SCQ can be gained by investigating the physics of composite systems. In this work, I show that the minus first law of thermodynamics, which is concerned with the approach to equilibrium, leads to a new approach to the SCQ, (...) the thermodynamic composition principle : Multiple systems in thermal contact compose a single system. This principle, which is justified based on a systematic classification of possible mereological models for thermodynamic systems, might form the basis of an inductive argument for universalism. A formal analysis of the TCP is provided on the basis of mereotopology, which is a combination of mereology and topology. Here, “thermal contact” can be analyzed using the mereotopological predicate “self-connectedness”. Self-connectedness has to be defined in terms of mereological sums to ensure that scattered objects cannot be self-connected. (shrink)
